FRIENDS OF LAPHROAIG 30TH ANNIVERSARY SHORT FILM

RECRUITMENT PHASE – CASTING CALL TERMS AND CONDITIONS

 

Summary

 

To mark the 30th anniversary of Friends of Laphroaig, we want to celebrate these friends who have helped build this community in to what it is today. To do this we are going to be creating a short film that heroes some of the members from around the world.

 

To find these friends, we are going to conduct a casting call, via the Laphroaig website, Laphroaig social media channels and a PR press release. 

 

Existing Friends of Laphroaig who want to apply, will be required to fill in a data capture form and encouraged to upload a 60 second video of themselves, explain what they love about being a friend of Laphroaig. This will all be done via this webpage on the Laphroaig website.

 

The applicants will be reviewed by the Laphroaig brand team and PR agency Stir. A shortlist of applicants will be chosen for virtual interviews, before deciding a select few friends to be filmed for the hero short film in May.

 

The successful applicants will be remunerated with Laphroaig merchandise.


 

Terms and Conditions

By applying the Friends of Laphroaig – Casting Call, you accept and agree to be bound by the following terms and conditions:

 

  1. The casting call is run by Beam Suntory UK Limited (“we” and “us”) (Company Number 5591988); our registered office is at 2 Longwalk Road, Stockley Park, Uxbridge, Middlesex, England, UB11 1BA.

     

  2. The casting call is open only to applicants who are 25 years of age and older, above the legal drinking age in their home country and who are registered at the time of application as a Friend of Laphroaig for a minimum period of 12 months. Proof of age will be required for any successful applicants located in the US and may be required for any winners located in other countries.

     

  3. To apply: You must be registered as a Friend of Laphroaig. Registration as a Friend of Laphroaig will enter you into the Friends of Laphroaig Rewards Programme (“FOL Programme”). Any Friend of Laphroaig who has been registered for more than 12 months can enter the casting call by, submitting their current information in to the Submission Form located on the Laphroaig website, along with a 60 second video and then clicking on the “Apply” button on the Friends of Laphroaig website. Entries are limited to one per registered Friend of Laphroaig.

     

  4. Submission must comply with these Official Rules:

  • Must not contain material that violates or infringes another's rights, including, but not limited to, privacy, publicity or intellectual property rights, including copyright infringement, or legal or moral rights of any third party, living or deceased;

  • Must not disparage Sponsor, Administrator or any other person or party affiliated with the promotion and administration of this Contest;

  • Must not include any personally identifiable information; 

  • Must be the original work of the entrant and must not contain images or artwork, music, quotes, parodies or other materials not created by entrant;

  • Must not feature brand names, logos or trademarks other than Sponsor’s trademarks in any other element of the entry or image, which Sponsor has granted, with respect to the Sponsor’s trademarks, entrant a limited license to use for purposes of this Contest;

  • Must not have been submitted previously in a promotion or contest of any kind and has not been exhibited or distributed currently or previously in any media;

  • Must not contain, facilitate, reference, or use material that is fraudulent, inappropriate, indecent, lewd, pornographic, obscene, hateful, tortious, defamatory, slanderous or libelous; 

  • Cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, or contain nudity or any materially dangerous activity;

  • Must not contain, facilitate, reference or use material that contains prohibited content which shall include, but is not limited to content that promotes, suggests, or encourages:

  • gambling, including without limitation, any content related to online casinos, sports books, bingo or poker;

  • the use of firearms/weapons/ammunition, any illegal drugs, prostitution, pornography, nudity, profanity or other adult content, violence, or the use of alcohol or tobacco products;

  • the taking up of arms against any person, government or entity or otherwise challenge or seek to overthrow any government;

  • Must not contain any viruses, spyware, malware, or other malicious components that are designed to harm the functionality of a computer in any way;

  • Must not contain, facilitate, reference, or use material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, ethnicity, religion, nationality, disability, sexual orientation, political orientation, citizenship, ancestry, marital status, or age; and 

  • Must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where the Submission was created.

 

Entrant must have approval from any persons appearing in the Submission and be able to provide express written consent of every such person appearing in the Submission to Sponsor and/or Administrator if requested.

NOTE: If any Submission fails to comply with any of these Submission Requirements or any other provisions of these Official Rules, Sponsor and Administrator reserve the right, but is not obligated, to disqualify the entrant.

 

Any entrant who incorporates any intellectual property owned by a third party into their Submission does so at their own risk. Without in any way limiting, expanding or amending the terms and conditions residing on any Contest-related website, including the Website, which terms and conditions shall remain in full force and effect, if Sponsor is duly notified that any element of an entrant’s Submission infringes upon the rights of another person and/or receives a legally valid request to remove the affected Submission from any Contest-related website because of such infringement, such Submission may be disqualified from the Contest, as Sponsor may determine in its sole discretion. Further, no entrant will be eligible to receive a prize unless Sponsor determines, in its sole and absolute discretion, that such entrant’s Submission has been or can be sufficiently cleared for legal purposes and such entrant eligibility is verified.  Each person who enters this Contest represents and warrants as follows: (i) the Submission is the entrant’s own original; (ii) the Submission has not been previously published; (iii) the Submission has not won previous awards; (iv) the Submission does not contain any computer virus (as applicable), is otherwise uncorrupted, is wholly original with entrant, and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (v) the Submission does not and will not violate or infringe upon the intellectual property rights or other rights of any third party; (vi) entrant has obtained permission from any person whose name, likeness or voice is used in the Submission; and (vii) the Submission does not and will not violate any applicable laws, and is not and will not be defamatory or libelous.  Each entrant hereby agrees to indemnify and hold the Contest Entities harmless from and against any and all third-party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder.

 

Each entrant retains ownership of their Submission. By submitting a Submission, entrant hereby grants permission for the Submission to be publicly posted, at Sponsor’s sole discretion. By submitting a Submission, entrant grants Sponsor an unlimited, worldwide, royalty-free, irrevocable, perpetual, license and right to publish, use, publicly perform and display the Submission in whole or in part, in any way, in any and all media, without limitation, and without consideration to the entrant, for promotional or marketing purposes. The Contest Entities are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected entries, Submissions – all of which will be void. Sponsor reserves the right to disqualify any entrant and/or Submission in its sole and absolute discretion.

 

  1. There is no alternative method of application. There is no application fee, and no purchase is necessary to enter this casting call.

     

  2. Only one application per person is permitted. No multiple applications will be accepted. Bulk or third party applications will not be accepted. Applications will be deemed made only by the registered Friend of Laphroaig who redeems the points on the FOL Programme.

     

  3. Our employees and their immediate families, our agents or anyone else professionally connected with us or the casting call shall not be permitted to enter.

     

  4. All valid entries must be received by 23:50 on 12th May 2024 which is the final day of the casting call. After this date, no further applications will be permitted. No responsibility can be accepted for applications not received for whatever reason up to and following the above date.

     

  5. All valid applications will be reviewed by Beam Suntory and its third-party agency partners. A shortlist of applicants will then be selected for virtual video call interviews. The shortlisted applicants will be contacted within three weeks of the casting call closing date and will be required to be available for a virtual video call within that three week period. 

     

  6. Following these interviews a final selection of applicants will be chosen to take part in the campaign film. The final selection of applicants will be contacted within two weeks of the virtual video calls and will be required to be available for filming in their local region within the following four week period. The final selection of successful applicants will be remunerated with Laphroaig merchandise.

     

  7. All reasonable efforts will be made to contact shortlisted and successful applicants . However, if an applicant has not responded to our correspondence within 7 days of the initial contact, then an alternative applicant may be selected. Any applicants located in the US will be required to complete and return an affidavit upon notification confirming information including birthdate. We have full discretion when applying these Terms & Conditions and our decision is final and no correspondence will be entered into in this regard.

     

  8. We are not responsible for the actions of applicants in connection with this casting call in attempting to either circumvent these terms and conditions or interfere with the administration, security, fairness, integrity or proper conduct of the casting call. Any applicant found to be tampering with or abusing the entries to this casting call or anyone who we believe to be causing error or malfunction or disruption or damage may result in that applicants removal from this casting call and their removal from the FOL Programme.

     

  9. All personal information collected from applicants in connection with participation in this casting call will be used as provided in Beam Suntory’s Privacy Policy, available at https://www.beamsuntory.com/en/privacy-policy. By entering the casting call applicants agree that their personal data submitted as part of the casting call process will be stored and processed on our behalf as data controller in accordance with applicable data protection laws as follows. Applicants agree that such data may be used by us and by any data processors appointed by us for the purposes of business analysis and research with a view to improving the Friends of Laphroaig Programme, for the administration of this casting call and to contact the shortlisted and successful applicants of the casting and that successful applicants data entered into the submission form will be provided to third parties on request. A request to access, update or correct any information should be directed to us here. We may share applicants’ personal data with our casting call delivery partner, Stir Public Relations Limited. We are careful about what we share and what our delivery partners can do with it and have suitable agreements with them in place. We will only hold applicants’ personal data for as long as we carry out the activities referred to above or have a valid reason to keep it.

     

  10. Applicants agree that any photograph and/or film of them during their participation in the casting call may be used for the intended purposes of the casting call and short film.

     

  11. Applicants give exclusive permission to use their image or video throughout the casting call and filming process, including permission to publish their image or video on the internet, in its original format, edited, or altered in any way that we deem appropriate.

     

  12. The applicants do not object to us storing copies of the image or video for as long as necessary to fulfil the casting call and subsequent shot film filming and promotion.

     

  13. These terms and conditions constitute the entire agreement between us and supersedes and extinguishes all previous drafts, agreements, arrangements and understandings between us, whether written or oral, relating to its subject matter. These terms and conditions cannot be altered or modified.  All parties agrees that it shall have no remedies in respect of any representation or warranty (whether made innocently or negligently) that is not set out in this document. 

     

  14. If any wording in these terms and conditions is held, in part or in full, to be invalid or unenforceable for any reason, the validity of the remaining clauses of this document shall not be affected, and they shall continue to be valid and enforceable. The invalid and unenforceable provision shall be replaced with a valid provision which is as similar as possible in substance to the invalid or unenforceable provision. 

     

  15. We reserve the right to withdraw, amend or temporarily suspend the casting call in our absolute discretion, provided that we shall no exercise this right unreasonably.

     

  16. Neither we nor our agents accept responsibility for any technical or other difficulties experienced in participating in this casting call.

     

  17. Neither we nor our employees, agents and representatives accept responsibility for any loss, damage, or injury incurred by an applicant (or anyone else) as a result of their application in the casting call.

     

  18. This casting call and these Terms & Conditions are governed by Scots law and subject to the exclusive jurisdiction of the Scottish Courts.
